Durable Power of Attorney for Finances

A durable power of attorney lets someone pay your bills and manage your money if you cannot. Durable means it survives your incapacity, which is the only time it matters.

Without one, your family petitions the Superior Court for a conservatorship, which is public, expensive, and slow. This is the cheapest insurance in the entire folder.

Springing versus immediate

A springing power takes effect only when doctors certify you are incapacitated. It sounds safer and it works badly in practice, because the bank now needs medical documentation before it will honor anything, and getting two physicians to sign a letter takes weeks you may not have.

An immediate power is effective on signing. Your agent could theoretically use it tomorrow, which is why the choice of agent carries the whole weight. Most of my clients choose immediate, and most estate planning attorneys I know would say the same.

What your agent can do

  • Pay the mortgage, the property taxes, and the insurance.
  • Deal with Social Security, Medicare, and pension administrators.
  • Manage bank and brokerage accounts held outside your trust.
  • Sign your tax return and handle the FTB and the IRS.
  • Sell real property, but only if the document specifically grants that authority.

Certain powers, including making gifts and changing beneficiary designations, have to be granted expressly. A generic form that omits them leaves your agent stuck exactly where you needed them functional.

It dies when you do

A power of attorney ends at death, instantly. From that moment the successor trustee or the executor takes over. An agent who keeps writing checks after a death is acting without authority, and that gets messy fast.

The bank problem

Financial institutions refuse powers of attorney more often than they should, usually citing age or their own internal form. Two things reduce the friction. Use the California statutory form language where it fits, and give a copy to your bank now, while you are healthy, so it is on file before anyone is in crisis.

A refusal is not necessarily the last word in California, and there are remedies, but the remedy is a phone call from a lawyer or worse. Prevention is easier.

How it relates to your trust

The trust covers assets in the trust. The power of attorney covers everything else, including the retirement accounts that cannot go into a trust and any asset you forgot to retitle. They work as a pair, and a plan with one and not the other has a gap.

Questions we get asked

Can I name my two children jointly?

You can, and requiring both signatures slows everything down. Name one primary and one alternate instead unless you have a specific reason to require agreement.

Can my agent change my will or trust?

No. Testamentary decisions are personal and cannot be delegated. An agent manages assets. They do not rewrite your plan.

Does it need to be notarized?

Notarize it. A notarized power of attorney is accepted far more readily, and one that will be used for real property must be notarized to be recorded.

Can I revoke it?

Any time, while you have capacity. Sign a written revocation, notify your agent, and notify every institution that holds a copy. The last step is the one people skip.

Once yours is signed, take a copy to your primary bank branch and ask them to put it on file. It takes twenty minutes and it is the single highest-value follow-up step of anything we hand you.
